Terms of Service

These Terms of Service ("Terms") govern your use of the Situ.art website and mobile application (the "Service") operated by Situ.art ("we", "our", or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Account Registration

To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account.

2. Acceptable Use

You agree not to:

  • Upload, generate, or distribute content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
  • Use the Service to infringe upon any third party's intellectual property rights.
  • Attempt to circumvent usage limits, rate limits, or other restrictions imposed by the Service.
  • Use automated tools (bots, scrapers, etc.) to access the Service without our written permission.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Use the Service to generate images that depict illegal activity or exploit minors.

3. Subscriptions & Payments

Free Tier

The Service offers a free tier with limited usage. Free tier limits are subject to change at our discretion.

Paid Subscriptions (Web)

Paid subscriptions purchased through the website are billed on a recurring monthly or annual basis via Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel.

In-App Purchases (iOS)

Subscriptions purchased through the iOS application are processed by Apple via the App Store. Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions in your Apple ID account settings.

Auto-Renewal

Subscriptions automatically renew at the end of each billing period. For web subscriptions, you can cancel at any time through the billing portal accessible from your Settings page. For iOS subscriptions, you can cancel through your Apple ID account settings. Cancellation takes effect at the end of the current billing period.

Refunds

We do not offer refunds for partial billing periods. If you cancel your subscription, you will continue to have access to paid features until the end of your current billing period. For iOS purchases, refund requests must be directed to Apple in accordance with their refund policies.

Price Changes

We reserve the right to change subscription prices. Any price changes will take effect at the start of your next billing period, and we will notify you in advance.

4. Intellectual Property

Your Content

You retain all rights to artwork images you upload to the Service. By uploading content, you grant us a limited, non-exclusive licence to process, store, and display your content solely for the purpose of providing the Service.

Generated Images

Images generated by AI services through Situ.art may be subject to the terms and conditions of the underlying AI service providers. We do not claim ownership of generated images, but your rights to use them may be governed by these providers' terms.

Our Content

The Service, including its design, features, and documentation, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute the Service or its components without our written permission.

5. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE.

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

6. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

7. Termination

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms. You may delete your account at any time through the Settings page. Upon termination, your data will be permanently deleted as described in our Privacy Policy.

8. Apple App Store

If you access the Service through the iOS application downloaded from the Apple App Store, the following additional terms apply:

  • These Terms are between you and Situ.art, not Apple Inc. Apple is not responsible for the Service or its content.
  • Apple has no obligation to provide any maintenance or support services for the Service.
  • In the event of any failure of the Service to conform to applicable warranties, you may notify Apple and Apple will refund any applicable purchase price. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the Service.
  • Apple is not responsible for addressing any claims relating to the Service, including product liability claims, any claim that the Service fails to conform to any applicable legal or regulatory requirement, or claims arising under consumer protection or similar legislation.
  • In the event of any third-party claim that the Service or your possession and use of the Service infringes that third party's intellectual property rights, Apple will not be responsible for the investigation, defence, settlement, or discharge of any such intellectual property infringement claim.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
  • You represent and warrant that you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

9. Modifications to Terms

We may modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. For material changes, we will notify you via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
